You are responsible for “ensuring that your visa or residency status permits you to undertake an unpaid vocational placement in Australia.” We do not provide migration advice.

To be considered as having successfully completed the Program and to remain eligible for Professional Internship Program and Placement Support components, you must:

(a)

attend at least 80% of scheduled live sessions;

(b)

complete all required assignments, projects, and assessments; and

(c)

4.

Nature of the Program

4.1

The Program is a cohort-based education, training and career-readiness program. It comprises, depending on your Plan: live training delivered on Tuesday and Saturday evenings (recorded); 15+ live industry projects; recorded courses; AI enablement training; the Certification Pathway; 1:1 mentorship; and, under the relevant Plans, the Professional Internship Program and the Job Placement Support Program.

4.2

The duration of the Program depends on your Plan:

(a)

Training Only: approximately 14 weeks of training, comprising AI enablement and program kick-off; Power BI, SQL, Excel, Python, Databricks, Microsoft Fabric and Py-Spark training and practice; live industry projects; Microsoft PL-300 examination preparation; portfolio finalisation; and job readiness;

(b)

Training + Guaranteed Internship (subject to eligibility and successful completion of program requirements under clause 10: approximately 26 weeks, comprising the 14-week training component described in paragraph (a), followed by the 12-week Professional Internship Program;

(c)

Training + Placement Support: approximately 26 weeks, comprising the 14-week training component described in paragraph (a), followed by the 12-week active period of the Job Placement Support Program, plus the passive support described in clause 11.4; and

(d)

Training + Professional Internship Program + Job Placement Support: approximately 38 weeks, comprising the 14-week training component described in paragraph (a), followed by the 12-week Professional Internship Program, followed by the 12-week active period of the Job Placement Support Program, plus the passive support described in clause 11.4.

4.3

Durations in clause 4.2 are indicative. Actual duration may vary with cohort scheduling, public holidays, examination booking availability, the timing of your Professional Internship Program placement under clause 10, the timing of your handover to the Job Placement Support Program, and any deferral or pause at your request. A variation in duration does not affect the Fees for your Plan and does not create any refund entitlement, except as required by the ACL.

4.4

The Program is an education and mentoring service only. We are not a recruitment agency, an employment agent, a migration agent or a financial adviser, and we do not provide services of those kinds.

4.5

No employment outcome is guaranteed. Nothing in the Program, these Program Terms, our marketing materials or any statement by our personnel or partners is a guarantee, promise or representation that you will obtain employment, a particular role, a salary level, or any employment outcome, or that any outcome will occur within a particular timeframe. Employment outcomes depend on market conditions, employer decisions and your own effort. The only guarantees we give are those expressly set out in clauses 7, 9, 10 and 11, strictly on the terms of those clauses.

4.6

The Professional Internship Program is a training opportunity. Any Internship is an unpaid vocational placement provided solely to support your learning and professional development. It is not employment, and it must not be regarded as a form of employment by any person. Inclusion in Professional Internship Program is subject to clause 10.

4.7

Examples of outcomes, salary ranges, success stories and testimonials in our marketing materials are illustrative of individual experiences or market data only and are not a promise or prediction of your results.

4.8

We may update the curriculum, tools, trainers, session times or delivery platform from time to time to keep the Program current, provided the changes do not materially reduce the overall benefit of the Program to you. We will give you reasonable notice of material changes.

4.9

All Program Materials remain our intellectual property and may not be copied, reproduced, distributed, or used for commercial purposes without our prior written consent. You may use your completed project work for personal portfolio purposes only.

5.

Plans and Fees

5.1

The Plans, Fees, Enrolment Fees, instalment amounts and fee components are set out in the Fee Schedule. All Fees are in Australian dollars and, unless stated otherwise, include GST.

5.2

The Fees for your Plan are fixed at enrolment and will not increase for your cohort.

5.3

Under the Training Only plan, we pay the fee for one sitting of the PL-300 examination, booked through us. We pay a maximum of one examination fee per Student under any Plan, and only where the Fee Schedule states the examination fee is included; all other examination fees, including any resit, are payable by you (see clause 9.5). Certification examinations are administered by Microsoft and its authorised examination providers under their own terms.

6.

Payment Obligations and Continuing Liability for Fees

6.1

By enrolling, you commit to the whole Program for your Plan and agree to pay the full Fees for that Plan, in the instalments and on the dates set out in the Fee Schedule and your enrolment confirmation.

6.2

Why the commitment is whole-of-program: seats in each cohort are genuinely limited to protect 1:1 support quality; your enrolment reserves a seat that is then unavailable to another applicant; and we incur fixed third-party costs for your Plan (including placement, certification and job support costs) from early in the Program. The Fees are a genuine pre-estimate of the cost of delivering your Plan and are not a penalty.

6.3

Subject to clause 7 (Cooling-Off Period) and clause 1.4, the full Fees for your Plan remain payable, and no refund of Fees paid is available, where after the Cooling-Off Period you:

(a)

change your mind, or decide the Program is not for you;

(b)

obtain paid employment, a contract role or any other engagement during the Program, including before, during or after the Professional Internship Program or the Job Placement Support Program;

(c)

stop attending sessions, stop completing work, or otherwise disengage from the Program;

(d)

are unable to continue due to a change in your personal, work, family, financial or visa circumstances; or

(e)

complete the Program, or any component of it, earlier than scheduled.

6.4

For clarity, obtaining employment during the Program is a success, not a termination event. If you obtain employment during the Program, you remain entitled to complete all remaining components of your Plan, and all remaining instalments remain payable on their due dates.

6.5

Clause 6.3 does not apply where you validly terminate under the ACL for a failure by us to comply with a consumer guarantee, or where a refund is expressly provided under clause 7, 8, 9 or 10.

6.6

If an instalment is not paid within 7 days of its due date, we may suspend your access to live sessions, Program Materials, the Placement Process and the Job Placement Support Program until payment is made. If an instalment remains unpaid 21 days after its due date, we may terminate your enrolment under clause 21 and recover the unpaid balance as a debt, together with our reasonable costs of recovery. We will not exercise these rights where the non-payment arises from a genuine dispute raised in good faith under clause 22 before the due date.

6.7

We may withhold issue of certificates of completion while Fees remain unpaid, to the extent permitted by law. The Statement of Attainment is issued by the registered training organisation under its own obligations and rules.

7.

Cooling-Off Period: 7-Day Money-Back Guarantee

7.1

You may withdraw from the Program for any reason by giving written notice to:

any time before the end of the Cooling-Off Period, being 7 days from the Cohort Start Date. This means you can attend the first week of the Program and still withdraw.

7.2

If you withdraw under clause 7.1, we will refund all Fees you have paid, other than the Enrolment Fee (see clause 7.4), within 14 days of your notice, to your original payment method. No further instalments will be payable.

7.2.1

After the Cooling-Off Period, all Fees are strictly non-refundable except where required under the Australian Consumer Law, regardless of the extent to which the Program has been accessed, completed, or utilised.

7.3

On withdrawal under this clause, your access to the Program, the Program Materials, the Placement Process and the Job Placement Support Program ends, and you must not retain or use any Program Materials.

7.4

The Enrolment Fee is refundable only if you give written notice of withdrawal within 48 hours of paying it. After that 48-hour period, the Enrolment Fee is non-refundable except as required by the ACL, because it covers seat reservation, onboarding and administration costs incurred at enrolment.

7.5

This clause 7 is in addition to, and does not limit, your rights under the ACL.

8.

Refunds After the Cooling-Off Period

8.1

After the Cooling-Off Period, refunds are not available for change of mind, and clause 6.3 applies. Refunds are available only:

(a)

as expressly provided in clause 9 (Certification Pathway), clause 10 (Professional Internship Program) or clause 11 (Job Placement Support Program);

(b)

where we cancel your cohort before the Program is completed and do not offer you a place in a comparable cohort within 3 months, in which case we will refund a pro-rata portion of Fees paid for the components not delivered; or

(c)

where required by the ACL, including where there is a major failure in the services we supply or where services are not supplied within a reasonable time.

8.2

Where a refund is payable, it will be paid within 14 days to your original payment method unless you agree otherwise in writing.

9.

Certification Pathway and Certification Support Guarantee

9.1

The Program includes structured preparation for the Microsoft Certified: Power BI Data Analyst Associate certification (exam PL-300), including recorded courses, live sessions, practice examinations and preparation materials, and exam-readiness review.

9.2

The PL-300 examination is set, administered and marked by Microsoft and its authorised examination providers. We do not control, and cannot and do not guarantee, the outcome of any examination, the conduct of any examination provider, or any decision of Microsoft. What we guarantee is the support set out in clause 9.4, on the conditions in clause 9.3.

9.3

Certification Support Guarantee: conditions. The guarantee in clause 9.4 applies where you have, before your first examination attempt:

(a)

completed all 15+ live industry projects to the standard notified in the project briefs;

(b)

completed all recorded courses in full;

(c)

attended all live training sessions, or, for any session missed, watched the recording and provided verifiable evidence of completion (to be verified by the lead or Associate trainer) within 7 days of the session;

(d)

actively participated in sessions, including by asking questions, contributing to project work and completing set actions between sessions;

(e)

completed all examination preparation materials and practice examinations provided through the Program, achieving the published readiness benchmark on the practice examinations; and

(f)

been assessed as exam-ready by your lead trainer against the published exam-readiness criteria. That assessment will be made reasonably and against objective criteria (project completion, practice examination scores and participation records), and if readiness is not confirmed, we will tell you in writing what remains outstanding and give you a reasonable opportunity to complete it.

9.4

Certification Support Guarantee: what we provide. If you have satisfied every condition in clause 9.3 and you do not pass the PL-300 examination at your first attempt, we will, at no additional cost to you:

(a)

provide a structured review of your examination result and additional targeted preparation;

9.5

One examination fee only. Where your Plan includes an examination fee, we pay the fee for one sitting of the PL-300 examination only, booked through us. The fee for any further sitting, including any resit after an unsuccessful attempt, is payable by you directly to the examination provider. The guarantee in clause 9.4 is a guarantee of continued preparation support; it does not include payment of any further examination fee.

9.6

The guarantee in clause 9.4 does not apply where the failure or non-certification results from: examination misconduct or breach of the examination provider’s rules or non-disclosure requirements; use of unauthorised materials in or in connection with any examination; failure to sit a booked examination without reasonable cause; or provision of false information to us or to the examination provider.

9.7

This clause 9 is a service guarantee. It is a commitment to specified support on the conditions stated. It is not, and must not be read as, a warranty of examination outcome, and it is in addition to your ACL rights.

10.

Professional Internship Program (Internship Plan Only)

10.1

What is guaranteed

10.1.1

Under Professional Internship Program Plan, we guarantee that the Professional Internship Program Placement Partner will actively procure and facilitate a 12-week Internship placement for you, provided you are eligible under clause 3.2 and you comply with the requirements of the Placement Process set out in this clause 10. This is a guarantee that the placement service will be delivered and a placement actively procured for eligible, compliant Students. Placement with any particular Host Organisation, in any particular role, location or delivery format, is not guaranteed, and the Internship is not employment.

10.2

How the Professional Internship Program works

10.2.1

The Professional Internship Program runs 3 to 5 days per week over a 12-week period and involves specific academic commitments, delivered under the guidance of an academic supervisor and an industry mentor at the Host Organisation.

10.2.2

Placements are primarily sourced in the Melbourne and Sydney CBDs and surrounding metropolitan areas. Placements may be in-person, remote or blended. Delivery format depends on Host Organisation preference and cannot be guaranteed. If you live more than approximately 1.5 hours from the city centre by public transport, you are likely to be placed in a remote role.

10.2.3

Before your placement commences, you will enter a Training Agreement with the Professional Internship Program Placement Partner and the Host Organisation. You must comply with the Training Agreement. The Professional Internship Program Placement Partner holds a Voluntary Workers’ Insurance policy covering you for personal injury occurring as a result of your placement at the Host Organisation.

10.2.4

You consent to us providing your resume, contact details and relevant profile information to the Professional Internship Program Placement Partner and prospective Host Organisations for the purpose of the Placement Process, in accordance with clause 16.

10.3

Your obligations in the Placement Process

10.3.1

You must cooperate fully with the Placement Process, including by:

  • providing a complete and accurate resume;

  • responding to the Professional Internship Program Placement Partner within the response times notified to you;

  • attending all consultations, workshops and interviews arranged for you;

  • meeting minimum professional standards in all dealings with the Professional Internship Program Placement Partner and Host Organisations;

  • and attending and completing the placement in accordance with the Training Agreement.

10.4

Withdrawal from the Placement Process

10.4.1

You may be withdrawn from the Placement Process where:

(a)

the Professional Internship Program Placement Partner believes, on reasonable grounds, that you do not have the competency to complete an internship with a suitable Host Organisation;

(b)

you are not successful after 5 interviews with Host Organisations (you will be alerted after 3 unsuccessful interviews that withdrawal may be recommended); or

(c)

you do not cooperate with the Placement Process as described in clause 10.3, including failure to meet professional standards or response times or failure to attend consultations or interviews. In the first instance you will receive a written warning; on a second instance you may be withdrawn.

10.4.2

If you are withdrawn under clause 10.4.1, or you withdraw yourself from the Professional Internship Program Placement Process or decline to proceed with a placement, the full Fees for your Plan remain payable and no refund of the Professional Internship Program Component is available, except as required by the ACL.

10.5

If no internship placement is secured

10.5.1

If no Internship placement is secured for you within 12 weeks of the commencement of your Placement Process, despite you meeting all Program requirements and complying fully with clause 10.3, and you are not otherwise eligible for withdrawal under clause 10.4, then you may elect in writing either to:

(a)

remain in the Placement Process, in which case at their discretion the Professional Internship Program Placement Partner may continue working with you at no additional cost until a suitable placement is secured or you elect to withdraw; or

(b)

withdraw from the Placement Process and receive a refund of the Professional Internship Program Component of your Fees, paid within 14 business days.

10.5.2

The refund under clause 10.5.1(b) is the only refund available in respect of the Professional Internship Program, and no refund is payable in respect of the training, certification or job support components in that circumstance, except as required by the ACL. The 12-week period in clause 10.5.1 does not include any period during which the Placement Process is paused at your request or due to your unavailability.

10.5.3

Once you have been successful at interview with a Host Organisation, the Professional Internship Program Component is fully earned and non-refundable, even if you do not commence or complete the placement, except as required by the ACL.

10.5.4

No Refund for Professional Internship Program Non-Completion: If a student fails to commence, participate in, or complete a Professional Internship Program due to their own actions, inaction, unavailability, or failure to meet eligibility or conduct requirements, no refund of the Professional Internship Program Component of the Fees will be provided.

11.

Job Placement Support Program add-on (Career Coach Partner Support Plan Only)

11.1

Under a Placement Support Plan, following completion of your training (and, where applicable, your Professional Internship Program), you will be handed over to the Job Placement Support Program: a structured 12-week program run by the Career Coach Partner, an experienced Australian career coach.

11.2

The Job Placement Support Program includes:

a)

a free group orientation call before the official start;

b)

one free group session with resume feedback during the first 7 days;

c)

an on-demand module library with progression gated on completed actions;

d)

two live interactive group sessions per week;

e)

full market setup within the first 3 weeks (LinkedIn optimisation, Seek profile optimisation, recruiter registrations);

f)

a dedicated structured session on government selection criteria;

g)

data-driven tracking of your applications, progress and goals with weekly accountability checks;

h)

interview preparation including the mock interviews;

i)

and offer evaluation and salary negotiation guidance.

11.3

A 7-day cooling off period applies from your Job Placement support program orientation call. You may withdraw from the Job Placement Support Program during that period by written notice; structured delivery commences at the end of that period. Withdrawal from the Job Placement Support Program does not reduce the Fees for your Plan except as required by the ACL (Australian Consumer Law).

11.4

After the 12-week active period, passive support continues by chat until you accept a written offer of paid employment or a paid contract role in Australia, with responses within 2 business days. If you remain unplaced 90 days after the end of the active period, a review of your situation will be held to agree next steps by the Career Coach.

11.5

The 90-Day Interview Guarantee

11.5.1

The Interview Guarantee is: if you do the work with the Job Placement Support Program for 90 days, you will land interviews, or the Career Coach Partner will keep working with you free of charge until you do.

11.5.2

The Interview Guarantee applies where you:

(a)

complete the resume and cover letter fixes identified in your gap report or session feedback;

(b)

optimise your LinkedIn profile as directed;

(c)

submit the recommended tailored applications each week and meet the minimum application standard of the Job Placement Support Program, currently 5 tailored applications per day from Week 3, checked weekly;

(d)

run the outreach templates provided and log your follow-ups; and

(e)

sign and comply with the Candidate Commitment Agreement described in clause 12.2.

11.5.3

Whether you have met the conditions in clause 11.5.2 is assessed against the tracking data maintained in the Job Placement Support Program, which will be made visible to you on request. Every condition in clause 11.5.2 is a step in the job search system itself; the conditions exist because running the system is what produces interviews.

11.5.4

The remedy under the Interview Guarantee is continued delivery of the Job Placement Support Program services free of charge. The Interview Guarantee is a guarantee of continued service and of interviews for Students who run the system. It is not and must not be read or represented by anyone as, a guarantee of employment, a job, a salary, a timeframe to employment, or any employment outcome, and no monetary refund is payable under it, except as required by the ACL.

12.

Your Obligations

12.1

Program outcomes depend heavily on your commitment. Throughout the Program you must:

a)

attend live sessions or watch recordings promptly;

b)

complete pre-work, assignments and projects by their due dates;

c)

actively participate in mentoring and feedback sessions;

d)

act on feedback;

e)

maintain professional communication standards with our team, the Professional Internship Program Placement Partner, Host Organisations and the Career Coach Partner;

f)

and engage honestly at all times. We are not responsible for lack of progress or outcomes arising from insufficient participation, missed sessions or failure to complete required work.

12.2

Before the official start of the Job Placement Support Program, you must sign a Candidate Commitment Agreement under which you agree to attend scheduled sessions, complete agreed actions between sessions, apply for suitable roles every week, maintain professional communication standards, act on feedback, attend interviews when opportunities arise, and engage honestly throughout. You may only be removed from the Job Placement Support Program with our prior written approval.

13.

Conduct, Academic Integrity and Removal

13.1

You must not:

  • harass, intimidate or disrespect any student, trainer, mentor, partner or Host Organisation personnel;

  • engage in dishonest conduct, including plagiarism, misrepresentation of your work or credentials, or cheating in any assessment or examination;

  • share, publish, sell or distribute Program Materials or session recordings;

  • record sessions without consent; or

  • bring us, the Professional Internship Program Placement Partner or the Career Coach Partner into disrepute.

13.2

If you breach clause 13.1, we may issue a written warning and, for serious or repeated breaches, suspend or terminate your enrolment under clause 21. Where enrolment is terminated for serious misconduct, Fees paid are not refundable and unpaid instalments for services already delivered or committed remain payable, except as required by the ACL.

14.

Deferral

14.1

You may apply in writing to defer your enrolment to the next available cohort once, on compassionate or compelling grounds. Deferral is at our reasonable discretion and subject to seat availability. On an approved deferral, Fees paid carry over to the new cohort and your instalment schedule is adjusted accordingly. A deferral does not create any refund entitlement.

15.

Intellectual Property

15.1

We (or our licensors and partners) own all intellectual property in the Program and the Program Materials. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Program Materials for your personal education during and after the Program. You must not copy, share, publish, sell, sublicense or commercially exploit any Program Materials.

15.2

You own the intellectual property in the original project work you create in the Program, and you may use it in your portfolio. You grant us a non-exclusive, royalty-free licence to use de-identified examples of student project work for education and quality purposes. We will not use your name, image or identifiable work in marketing without your prior consent under clause 17.

16.

16.1

We handle your personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.

16.2

By enrolling, you consent to us collecting, and disclosing to the Professional Internship Program Placement Partner, prospective Host Organisations, the Career Coach Partner and the registered training organisation, your personal information (including your resume, contact details, participation and progress records, applications data and, where relevant, assessment results) solely for the purposes of delivering your Plan. Each recipient is required to handle your personal information in accordance with the Privacy Act 1988 (Cth).

16.3

You may withdraw a consent under clause 16.2 by written notice, but withdrawing consent may make it impossible for us to deliver the Internship or the Job Placement Support Program, and does not create any refund entitlement except as required by the ACL.

16.4

Live sessions are recorded for delivery of the Program. By participating, you consent to appearing in session recordings made available to your cohort. Recordings are Program Materials.

17.

Testimonials and Marketing

17.1

We may invite you to provide a testimonial or review. Providing one is entirely voluntary and is never a condition of any service, guarantee or outcome. We will only use your name, image or story in marketing with your prior written consent, which you may withdraw for future use at any time.

To the extent permitted by section 64A of the ACL, our liability for a failure to comply with a consumer guarantee in relation to services not of a kind ordinarily acquired for personal, domestic or household use is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.

20.

Liability

20.1

Subject to clause 19, and to the extent permitted by law: we are not liable for indirect or consequential loss, loss of income, loss of opportunity or loss of anticipated earnings arising out of or in connection with the Program; we are not liable for the acts or omissions of any Host Organisation, examination provider or other third party outside our reasonable control, except to the extent we caused or contributed to the relevant loss; and our total aggregate liability to you arising out of or in connection with the Program is limited to the total Fees you have paid to us.

20.2

You indemnify us against loss, damage and reasonable costs we incur arising from your fraudulent or dishonest conduct, your breach of clause 13 or clause 15, or any claim by a Host Organisation arising from your serious misconduct during an Professional Internship Program, except to the extent we caused or contributed to the loss. Nothing in this clause requires you to indemnify us for our own negligence or breach.

21.

Suspension and Termination

21.1

We may suspend or terminate your enrolment by written notice if:

  • you materially breach these Program Terms and, where the breach can be remedied, fail to remedy it within 14 days of written notice;

21.2

On termination of your enrolment, your access to the Program, Program Materials, the Placement Process and the Job Placement Support Program ends. The consequences for Fees are as set out in clauses 6, 7, 8, 10 and 13, always subject to clause 19.

21.3

Clauses 1.4, 15, 16, 17, 18.1, 19, 20, 22 and 23, and any accrued rights, survive termination.

21.4

c)

breach any provision of these Program Terms.

In such cases, no refund will be provided, and any outstanding Fees will remain payable.

These Program Terms, the Fee Schedule, your enrolment confirmation, the General Platform Terms and Conditions and our Privacy Policy form the entire agreement between you and us for the Program.

23.2

We may amend these Program Terms for future cohorts at any time. For your current enrolment, we may only amend these Program Terms where the amendment is required by law or does not materially reduce your rights, and we will give you at least 14 days’ written notice of any amendment.

23.3

If any provision of these Program Terms is unenforceable, it is severed to the minimum extent necessary, and the remainder continues in force. A waiver is effective only if in writing. You may not assign your enrolment without our prior written consent; enrolment is personal to you and must not be shared.

23.4

Notices to us must be sent to [email protected]. Notices to you will be sent to the email address in your enrolment record and are effective when sent, absent a delivery failure.
